RATING History. In Europe: 1989-5-5 with
Strasbourg, European Convention on transborder television (signed by France the
12-2-1991, approved 28-6-1994). -3-10 directive 89/552 the EEC of the Council,
art. 22 "Television without borders": the Member States in particular
take all suitable measurements so that the diffused emissions "do not comprise
any program likely to harm seriously physical, mental or moral blooming of the
minors, (...) of the scenes of pornography or free violence". 1997-20-6 directive
97/36 EC of the Parliament and the Council Europeans modifying the directive of
1989. In France: art. L. 227-24 of the Penal code punishes 3 years of imprisonment
and 75 000 · of fine "makes it is to manufacture, to transport, diffuse
by some means that it is and whatever a message in violent or pornographic matter
is the support, when this message is likely to be seen or perceived by a minor".
1986-30-9 law 86-1067, art. 15: "the SCA takes care of the adolescence and
child welfare in the programming of the emissions diffused by a service of audio-visual
communication" 1989-5-5 recommendation of the SCA: the chains must abstain
from "diffusing emissions, in particular ·uvres cinematographic or
audio-visual, in erotic matter or of incentive to violence, between 6 a.m. and
22. 30" and "particularly taking care that the trailers of these emissions
are not diffused before 8 p.m. 30 and that they do not comprise scenes likely
to run up against the sensitivity of the children and teenagers". -29-6 letter
of the SCA to the diffusers specifying the terms of the recommendation. 1990-23-2
decree relating to the classification of the cinematographic ·uvres: force
on the chains TV to inform beforehand the public of prohibitions in room to the
minors "as well at the time of the passage to the antenna as in the advertisements
of the programs diffused by the press, broadcasting and television". 1991-25-3
letter of the SCA to the diffusers on films prohibited with less than 12 years:
it rests to the leaders of the chains to judge if, because of seniority of its
visa, a film is not likely any more to shock the sensitivity of the public, taking
into account the evolution of the m·urs; it is recommended to them to adapt
the programming to family public for the evening of Tuesday and in period of school
holidays. 1992-27-3 decree 90-280: "publicity must be (...) free from any
scene of violence" (Article 4) and "does not have to carry damage to
the minors" (Article 7). 1996-Nov.. on the initiative of the SCA, 1st pictograms
coloured with the bottom of the screens of the hertzian national chains in light.
the 1998-17-6 law the 98-468 far-sighted prohibition "of provision of certain
documents to the minors" makes it possible to sanction the hiring, the sale
or the publicity of cassettes or video games presenting a serious danger to youth.
-31-8 harmonization of the pictograms of the chains in light with those used by
Canal+ since its creation. 1999-7-9 decree 99-771 creating the Commission charged
to examine measurements of prohibition. 2000 (beginning) setting in ·uvre
of descriptive on the majority of the chains of the cable (the chains of information,
sporting, for children and family are exempted by it). the 2002-12-6 SCA presents
at the hertzian chains a clearer coding: a number in a round indicates the age
below which the program is disadvised (less than 8,12,16 and 18 years); entry
into force envisaged at the end of 2002. -18-7 D. Baudis (Pt of the SCA) meets
Christian Jacob (min. deputy with the Family) to propose to prohibit the diffusion
of pornographic films to the TV (950/month on cable and satellite).
Categories. I (white rhombus registered in a green circle): works
for all public. Programming in light: the chains are not held to use this pictogram.
Into encrypted: Canal+ signposts these works. II (white round in a blue
circle with the minimun 60 seconds at the beginning of program or during the diffusion
of the credits and at least 10 S after the possible program interrupt): ·uvres
comprising certain scenes likely to run up against the young public. Schedules
of diffusion left with the appreciation of the company but, trailer included/understood,
neither in nor near the emissions for children. III (white triangle in an
orange round throughout all diffusion): ·uvres cinematographic prohibited
with the 12 year old minors, as well as the ·uvres being able to disturb
the young public, in particular when the scenario resorts in a way systematic
and repeated to physical or psychological violence. In light: before 10 p.m.:
in exceptional circumstances only, except Tuesday, Friday, Saturday and day before
of public holiday; trailer: free from scenes likely to run up against the sensitivity
of the young public, cannot be diffused near the emissions for children. Into
encrypted: free schedule but the emissions intended for the young public and the
trailers being next to them should not comprise scene likely to run up against
the sensitivity of the young televiewers. IV (white square in red round
during all the diffusion; mention "adult public" or of prohibition to
the 16 year old minors during at least 10 S at the beginning of program or the
credits): ·uvres cinematographic prohibited with the 16 year old minors,
as well as the ·uvres in erotic matter or of great violence, likely to
harm physical, mental or moral blooming of minors the 16 year old. In light: reserved
for a public informed, diffusables after 10 p.m. 30; trailers: free from scenes
likely to run up against the sensitivity of the young public, diffusables after
8 p.m. 30. Into encrypted: except Wednesday before 8 p.m. 30, Saturday morning
and Sunday morning; trailers containing of the scenes of violence or the scenes
likely to run up against the sensitivity of the young public: idem + except part
in light of the program. V (white cross in a purple round): ·uvres
cinematographic prohibited with less than 18 years like those reserved for an
informed public. In light: completely prohibited diffusion. Into encrypted: between
0 a.m. and 5 H. For the chains overseas, the schedules of programming
hold account of the way of life and the hours of great listening different from
those of the metropolis. Committees
of visionnage. The responsibility for their installation falls on each chain which
informs the SCA of their composition, but is only responsible for its decisions
of classification. TF1: are members of the committee the persons in charge for
various units (fiction, youth, planning of the antenna, acquisition, marketing)
placed under the authority of the director of the antenna; correspondents of classification
named by the various structures of provisioning are in charge of its daily setting
in ·uvre. M6: committee of mothers from 25 to 40 years; attached to the
